Man alleges he is still disabled and Metro Life wrongfully terminated benefits

SAN FRANCISCO – An IVZ Inc. employee alleges his disability benefits were wrongfully terminated.

David Do filed a complaint on Sept. 2 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in March 2013, he became disabled because of medical conditions. The suit states he was initially receiving disability benefits until the benefits were terminated on Sept. 6, 2015. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly terminated plaintiff's disability benefits despite having sufficient evidence to support his claim.

The plaintiff seeks benefits owed to plaintiff plus interest, declare plaintiff's rights to receive future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Brian H. Kim and James P. Keenley of Bolt Keenley Kim LLP in Berkeley.
