Lender Processing Center and Hightechlending Inc. accused of telemarketing

SAN DIEGO – A San Diego County man has filed a class-action suit against two mortgage lending companies over claims they called him for telemarketing purposes.

Kevin Lemieux filed a complaint on behalf of all others similarly situated on July 20 in the U.S. District Court for the Southern District of California against Lender Processing Center and Hightechlending Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in April, the defendants contacted him to solicit their services. The plaintiff holds Lender Processing Center; and Hightechlending Inc. responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff despite not having his express permission to contact him.

The plaintiff requests a trial by jury and seeks statutory damages, injunctive relief, all legal fees and any other relief as the court deems just. He is represented by Abbas Kazerounian and Jason A. Ibey of Kazerouni Law Group APC in Costa Mesa and Joshua B. Swigart of Hyde & Swigart in San Diego.
