Duck Foot Brewing Co. allegedly copied another brewing company's trademark

LOS ANGELES — A California craft brew business has filed suit against competitors for allegedly copying its trademark used for craft beers.

Eel River Brewing Co. Inc. filed a complaint Sept. 13 in U.S. District Court for the Central District of California against Duck Foot Brewing Co. LLC and Does 1 through 10, alleging that they used a confusingly similar trademark as plaintiff.

According to the complaint, the plaintiff alleges that Eel River Brewing Co. Inc. suffered damages from having its trademark used by a competitor. The plaintiff holds Duck Foot Brewing Co. LLC and Does 1 through 10 responsible because the defendants allegedly used the "California Blonde" mark on their beer, which caused confusion among the plaintiff's customers.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing the plaintiff's trademark, compensatory damages, punitive damages, all gains and profits derived from the unlawful act, to deliver up for destruction all infringing products, pay the plaintiff for corrective advertising, all legal fees and any other relief as the court deems just.
