SAN FRANCISCO — Former call center "advice nurses" have filed a class-action lawsuit against their former employer for alleged unpaid wages.

Debra Brown, Sandra Morton and Barbara Labuszewski filed a complaint on behalf of themselves and all other similarly situated individuals Sept. 14 in U.S. District Court for the Northern District of California against The Permanente Medical Group Inc., alleging that the employer failed to provide fair compensation to the plaintiffs for all hours worked.

According to the complaint, the plaintiffs allege that Debra Brown, Sandra Morton and Barbara Labuszewski worked for more than 40 hours pe rweek without being paid any overtime compensation or any compensation for off the clock work. The plaintiffs hold The Permanente Medical Group Inc. responsible because the defendant allegedly failed to pay the plaintiffs any overtime premium for hours worked that exceeded 40 per week, as well as failing to provide adequate meal breaks.

The plaintiffs request a trial by jury and seek all unpaid wages, liquidated damages, statutory damages, disgorgement and restitution, actual damages, all legal fees and interest plus any other relief as the court deems just. They are represented by Jahan C. Sagafi of Outten & Golden LLP in San Francisco and Kevin J. Stoops and Jesse L. Young of Sommers Schwartz P.C. in Southfield, Michigan.
