Man alleges he was wrongfully terminated from disability benefits by LINA

LOS ANGELES – An FMR Corp. employee alleges his disability benefits were wrongfully terminated.

Donald Wheeler filed a complaint on Sept. 23 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled and was initially paid disability benefits until its termination on April 21, 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny plaintiff's disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks payment of disability benefits due to plaintiff plus interest, determine that plaintiff is entitled to future disability benefits, all legal fees and any other relief as this court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
