Consumer alleges LG televisions are only energy efficient under default settings

LOS ANGELES – A San Jose woman alleges a brand of television was falsely misrepresented as energy efficient when changes to the TV's default settings affects the energy-saving capabilities on the device.

Veronica Munoz filed a complaint on behalf of all others similarly situated on Sept. 29 in the U.S. District Court for the Northern District of California against LG Electronics U.S.A. Inc. alleging breach of express warranties, unfair competition, breach of contract and other counts.

According to the complaint, the plaintiff alleges that she suffered damages from being misled into buying a falsely advertised product. The plaintiff holds LG Electronics U.S.A. Inc. responsible because the defendant allegedly misled consumers into buying its televisions, which it markets as energy efficient, but the device disables the energy-saving feature whenever users change the main picture setting, a feature which it neglected to inform its consumers.

The plaintiff requests a trial by jury and seeks for the defendant to disclose all studies and reports relating to the energy usage of its televisions; statutory damages; punitive damages; compensatory damages; restitution and disgorgement; engage in a corrective advertising; all legal fees and any other relief as the court deems just.
