LOS ANGELES – A Los Angeles County man has filed a class action against three debt collectors over allegations they harassed him with the frequency of their calls.
David Vaccaro filed a complaint on behalf of all others similarly situated on Oct. 7 in the U.S. District Court for the Central District of California against Transamerica Consumer Services, Findmydebt.info, Open Holdings LLC and Does 1 through 10 citing the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in July, the defendants called him numerous times in an attempt to collect an alleged debt. The plaintiff holds Transamerica Consumer Services, Findmydebt.info, Open Holdings LLC and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff and continued to call after he revoked his consent.
The plaintiff requests a trial by jury and seeks $500 in statutory damages for every violation, $1,500 in treble damages for every violation and any other relief as the court deems just.
