SAN DIEGO – An Arizona man alleges he was injured in an all-terrain vehicle accident in Imperial County

Braden Roberts filed a complaint on Oct. 5 in the U.S. District Court for the Southern District of California against Brent McElvain and Does 1-25 citing battery and negligence.

According to the complaint, the plaintiff alleges that on Jan. 17 he was driving an all-terrain vehicle at the Imperial Dunes. He alleges the defendants drove another all-terrain vehicle directly at him that negligently struck plaintiff, thereby causing him injury and damages including impairment, mental suffering, medical expenses, loss of earnings, property damage, inconvenience, anxiety and distress. 

The plaintiff holds McElvain and Does 1-25 responsible because the defendants allegedly engaged in acts with intent to cause injury.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages, expenses, interest, costs of suit and further relief as the court deem just. He is represented by Robert A. Buccola and Ryan L. Dostart of Dreyer Babich Buccola Wood Campora LLP in Sacramento.
