Construction worker claims Pinnacle Group Corp. did not pay overtime wages

SAN FRANCISCO – A construction worker alleges his former San Mateo County employer violated wage labor laws.

Edwin Garcia filed a complaint on Oct. 12 in the U.S. District Court for the Northern District of California against Mohammad Mortazavi and Pinnacle Group Corp. citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation and was not provided an itemized wage statement. The plaintiff holds Mohammad Mortazavi and Pinnacle Group Corp. responsible because the defendants allegedly failed to pay overtime premium to plaintiff for working more than 40 hours per week.

The plaintiff seeks compensatory damages for all unpaid wages and overtime wages, liquidated damages, statutory/ civil penalties plus interest, interest of 10 percent on all unpaid wages and overtime compensation, all legal fees and any other relief the court deems just. He is represented by Thomas E. Margain and Huy Tran of Justice at Work Law Group in San Jose.
