A labor group sues Gradetek Inc. over alleged failure to pay monthly contributions

CALIFORNIA — A labor group are suing Gradetek, Inc., a California corporation, citing alleged breach of contract.

The Board of Trustees of the Laborers Health and Welfare Trust Fund for Northern California, Board of Trustees of the Laborers Vacation-Holiday Trust Fund for Northern California; Board of Trustees of the Laborers Pension Trust Fund for Northern California; and Board of Trustees of the Laborers Training and Retraining Trust Fund for Northern California filed a complaint on Oct. 21, in the U.S. District Court for the Northern District of California against Gradetek, Inc. alleging that the California corporation failed to pay monthly fringe contributions to the labor group.

According to the complaint, the plaintiffs allege that the Board of Trustees of the Laborers Health and Welfare Trust Fund for Northern California, Board of Trustees of the Laborers Vacation-Holiday Trust Fund for Northern California; Board of Trustees of the Laborers Pension Trust Fund for Northern California; and Board of Trustees of the Laborers Training and Retraining Trust Fund for Northern California suffered damages due to unpaid and late paid fringed contributions. The plaintiffs holds Gradetek, Inc. responsible because the defendant allegedly breached their bargaining agreement with the plaintiff for failing to pay monthly contributions on behalf of their employees.

The plaintiffs seek unpaid contributions in the amount of $9,022.49 plus interest, liquidated damages, interest rate of 1.5 percent per month calculated to be $7,546, to order the defendant to submit to an audit, all legal fees and any other relief as this court deems just. They are represented by Ronald L. Richman, Susan J. Olson, and Heather J. Zacharia of Bullivant Houser Bailey PC in San Francisco.
