Hertz sued over administrative fees

CALIFORNIA — A subscriber have filed a class-action lawsuit against The Hertz Corp., a Florida business, citing alleged breach of contract and unfair business practices.

Edward Schwartz, Org Holdings and Org Portfolio Management LLC filed a complaint on behalf of all others similarly situated on Oct. 17, in the U.S. District Court for the Central District of California against The Hertz Corp. alleging that the Florida business overcharges the plaintiffs with excessive administrative fees.

According to the complaint, the plaintiffs allege that Edward Schwartz, Org Holdings and Org Portfolio Management LLC suffered damages from being overcharged. The plaintiffs holds The Hertz Corp. responsible because the defendant allegedly breached their rental agreement with the plaintiff by informing plaintiff that his rental car had incurred unpaid toll charges.

The plaintiffs request a trial by jury and seek damages, compensatory damages, treble damages, all legal fees and interest, enjoin the defendant from continuing to charge customers administrative fees for its transfer-of-liability process unless Hertz properly discloses these charges, plus any other relief this court deems just. Karon and Beau D. Hollowell of Karon LLC in Cleveland , Ohio.
