CALIFORNIA — A labor group is suing Jagur Tractor, a California corporation doing business as "Jagur Tractor Equipment Rental," and Big Cat Equipment Rentals LLC, employers, citing alleged breach of contract and a violation of the Employee Retirement Income Security Act (ERISA).

Trustees of the Operating Engineers Pension Trust, Trustees of the Operating Engineers Health and Welfare Fund, Trustees of the Operating Engineers Vacation-Holiday Savings Trust and Trustees of the Operating Engineers Training Trust filed a complaint on Oct. 20 in the U.S. District Court for the Central District of California against the defendants alleging that they failed to pay monthly contributions to the labor group

According to the complaint, the plaintiffs allege that Trustees of the Operating Engineers Pension Trust, Trustees of the Operating Engineers Health and Welfare Fund, Trustees of the Operating Engineers Vacation-Holiday Savings Trust and Trustees of the Operating Engineers Training Trust suffered damages due to unpaid and late paid benefit contributions. The plaintiffs holds Jagur Tractor, a California corporation doing business as "Jagur Tractor Equipment Rental," and Big Cat Equipment Rentals LLC responsible because the defendants allegedly breached their bargaining agreement with the plaintiff for failing to pay their contribution on behalf of their employees

The plaintiffs seek unpaid fringe benefits and other damages, liquidated damages, interest, all legal fees and interest, and any other relief this court deems just. They are represented by J. Paul Moorhead of Laquer, Urban, Clifford & Hodge LLP in Pasadena
