SAN FRANCISCO – A Magellan Health Services employee alleges her claim for disability benefits was wrongfully denied.

Julie Cass filed a complaint on Oct. 31 in the U.S. District Court for the Northern District of California against the Liberty Life Assurance Co. of Boston; Short Term Disability Plan for the employees of Magellan Health Services; and Magellan Health Services Long Term Disability Plan alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she became disabled and applied for a short-term disability benefits but was denied. The plaintiff holds Liberty Life Assurance Co. of Boston; Short Term Disability Plan for the employees of Magellan Health Services; and Magellan Health Services Long Term Disability Plan responsible because the defendants allegedly upheld their decision to deny plaintiff any disability benefits despite the findings of plaintiff's treating physician.

The plaintiff seeks award benefits in the amount not paid to the plaintiff plus interest, order to determine that plaintiff is entitled to future plan benefits, all legal fees and any other relief the court deems just. She is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
