Weso Insurance Co. claims it has no duty to indemnify Donel law firm

SAN DIEGO – An insurer alleges a Los Angeles law firm's legal matters are not covered under an insurance policy.

Weso Insurance Co. filed a complaint on Nov. 3 in the U.S. District Court for the Southern District of California against Benjamin Donel, Law Offices of Benjamin Donel Inc., Sunset Equity Partners LLC, The FARA San Martino LLC, Canyon Pottery Co. Inc. and John F. Devlin seeking declaratory relief.

According to the complaint, the defendants are involved in a lawsuit alleging breach of contract and other counts and that Donel had a policy with the plaintiff. The plaintiff alleges that it has no duty to defend the Law Offices of Benjamin Donel Inc. APC or Donel on the grounds that the claims are not within the scope of the agreement.

The plaintiff seeks judgment in its favor, judicial declaration of no coverage and no duty to defend, reimbursement of costs incurred for defense on the FARA action, interest, costs of suit and further relief as the court deems appropriate. It is represented by Robert D. Hoffman of Charlston, Revich & Wollitz LLP in Los Angeles.
