Motive Enterprise Inc., Ross Stores Inc., DD's Discounts accused of copyright infringement

LOS ANGELES – Three retailers are accused of selling garments using a fabric design copied from a copyrighted design.

Standard Fabrics International Inc. filed a complaint on Nov. 1 in the U.S. District Court for the Central District of California against Motive Enterprise Inc., Ross Stores Inc., DD's Discounts and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of the infringement of its designs. The plaintiff holds Motive Enterprise Inc., Ross Stores Inc., DD's Discounts and Does 1 through 10 responsible because the defendants allegedly manufactured and distributed garments featuring a fabric that has similar a design to the plaintiff's pattern.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, profits and damages, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
