Woman alleges Prudential violated ERISA with denial of disability benefits

LOS ANGELES – A Ventura County woman alleges she is disabled and her claim for disability benefits was wrongfully terminated.

Grace Acordon filed a complaint on Nov. 8 in the U.S. District Court for the Central District of California against Prudential Insurance Co. of America; HCA Management Services LP Long Term Disability Plan and Does 1 to 10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2013, she became disabled, applied for disability benefits and was initially granted benefits, but they were later terminated in 2015. The plaintiff holds The Prudential Insurance Co. of America; HCA Management Services LP Long Term Disability Plan and Does 1 to 10 responsible because the defendants allegedly denied plaintiff's disability benefits based on their claim that her disability does not prevent her from performing her duties as a certified nursing assistant.

The plaintiff seeks damages, disability benefits payable at the rate of $1,742.21 per month, interest, all legal fees and any other relief as the court deems just. She is represented by Kevin M. Zietz of Law Offices of Kevin M. Zietz PC in Encino and Todd Krauss of Law Offices of Todd Krauss & Associates in Encino.
