Unicolors alleges designs were used for clothes without permission

LOS ANGELES – Several retailers have allegedly sold garments featuring unauthorized versions of copyrighted fabric designs.

Unicolors Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California against the Cann Studio Inc., doing business as Oboe; Ross Stores Inc., individually and doing business as DD's Discounts; The TJX Cos. Inc., individually and doing business as Marshalls; Togetherbe LLC, individually and doing business as R2D; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Cann Studio Inc., doing business as Oboe; Ross Stores Inc., individually and doing business as DD's Discounts; The TJX Cos. Inc., individually and doing business as Marshalls; Togetherbe LLC, individually and doing business as R2D; and Does 1 through 10 responsible because the defendants allegedly used retail stores to advertise and distribute garments that bear plaintiff's designs.

The plaintiff requests a trial by jury and seeks enjoin the defendants, award all profits and damages to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
