Collier Building Specialties Inc. alleges it is owed for work on federal project

SAN FRANCISCO – A San Francisco subcontractor alleges it wasn't paid for work on a federal project.

United States of America, for the use of Collier Building Specialties Inc., filed a complaint on Nov. 21 in the U.S. District Court for the Northern District of California against the Federal Solutions Group Inc., Kirlin Builders LLC, John J. Kirlin Special Projects LLC, North American Specialty Insurance Co., Chubb Surety, Federal Insurance Co., Liberty Mutual Insurance Co. and Does 1-50 alleging breach of contract.

According to the complaint, on March 10, 2015, Collier Building Specialties Inc. contracted with the defendants to furnish and install a Kalwall Translucent Panel Wall System for the Camp Parks Dining Facility, property of the United States of America, for the contract price of $32,000. The suit states the defendants' payment obligations were secured by a payment bond issued by Nasic. The suit states that Collier performed all of its obligations under the contract, however, the defendants refused to pay the contract price of $32,000 without just cause.

The plaintiff holds Federal Solutions Group Inc., Kirlin Builders LLC, John J. Kirlin Special Projects LLC, North American Specialty Insurance Co., Chubb Surety, Federal Insurance Co., Liberty Mutual Insurance Co. and Does 1-50 responsible because the defendants allegedly failed to compensate plaintiff for its materials and services provided to the project and refused to pay under the conditions of the surety bond.

The plaintiff requests a trial by jury and seeks judgment against defendants, in the sum of $32,000, plus interest, attorney's fees, costs incurred and further relief as the court may deem proper. They are represented by Louis Spitters of Law Offices of Louis Spitters in San Jose.
