LOS ANGELES – A Riverside County business is accused of not paying employee contributions.
Trustees of the Operating Engineers Pension Trust, Trustees of the Operating Engineers Health and Welfare Fund, et al. filed a complaint on Dec. 2 in the U.S. District Court for the Central District of California against Sully's Precision Grading LLC alleging breach of written collective bargaining agreement and other counts.
According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late-paid fringe contributions. The plaintiffs holds Sully's Precision Grading LLC responsible because the defendant allegedly breached their bargaining agreement with the plaintiff by failing to pay their contributions on behalf of their employees from April to June.
The plaintiffs seek unpaid fringe benefit contributions, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by J. Paul Moorhead of Laquer, Urban, Clifford & Hodge LLP in Pasadena.
