Carpenters Southwest Administrative Corp. claims it is owed more than $17,000 in benefits

LOS ANGELES – Two contractors and their officers are accused of not paying contributions to a labor union and its funds.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on Dec. 9 in the U.S. District Court for the Central District of California, Western Division against National Retail Services Group Inc.; Starnes & Oswalt Construction Inc., also known as NRSG and doing business as Starnes & Oswalt; Lisa Oswalt; Sherry Riordan; and Does 1 through 10 citing the Labor-Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid or late paid contributions. The plaintiffs holds National Retail Services Group Inc.; Starnes & Oswalt Construction Inc., also known as NRSG and doing business as Starnes & Oswalt; Oswalt; Riordan; and Does 1 through 10 responsible because the defendants allegedly failed to pay fringe benefit contributions on behalf of their employees.

The plaintiffs seek unpaid contributions in the sum of $17,654.78 plus interest and liquidated damages, audit costs, statutory damages, all legal fees and any other relief as the court deems just. They are represented by Thomas Davis and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
