Individual claims Aetna wrongfully terminated benefits.

SAN DIEGO – A San Diego County man alleges his disability benefits were wrongfully terminated.

Donald Register filed a complaint on Dec. 8 in the U.S. District Court for the Southern District of California against Aetna Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled in December 2014 and was paid benefits by the defendant until June, when they were terminated. The plaintiff holds Aetna Life Insurance Co. responsible because the plaintiff is allegedly still disabled according to the terms of the plan.

The plaintiff requests a trial by jury and seeks judgment against defendant, past-due benefits at approximately $2,273 per month, interest, attorney’s fees, costs of suit and other relief as the court deems proper. He is represented by Brooks L. Iler and Virgil A. Iler of Iler & Iler LLP in San Diego.
