LOS ANGELES – Two trustees for several labor union funds allege a Canyon Country employer owes more than $150,000 in unpaid contributions.
Ana M. Hanson, for and on behalf of Southern California Painting & Drywall Industries Health & Welfare Fund, Southern California Painting and Decorating Labor management Cooperation Committee Trust Fund and Southern California Painting & Drywall Industries Apprenticeship Trust Fund; and Tim D. Maitland for and on behalf of International Painters and Allied Trades Industry Pension Fund filed a complaint on Dec. 22 in the U.S. District Court for the Central District of California, Western Division against
Everlast Builders Inc. and Vasilis Andrea Tsangarides
citing the Employee Retirement Income Security Act and the Labor Management Relations Act.
According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late-paid contributions from May to September 2016. The plaintiffs hold Everlast Builders Inc. and Tsangarides responsible because the defendants allegedly breached their bargaining agreement with the plaintiff by failing to pay fringe benefit contribution on behalf of their employees. The plaintiffs allege they are owed $127,648.61.
The plaintiffs seek the delinquent contributions, liquidated damages and interest, all legal fees and any other relief as this court deems just. They are represented by Anthony R. Segall and Michele Sherer Ancheta of Rothner, Segall & Greenstone in Pasadena.
