Fashiongo alleges individual is using mark for domain name

LOS ANGELES – A Los Angeles business alleges an individual in Vietnam that does business in the state is using its name for a website.

Bee 3 Stars Corp., doing business as Fashiongo, filed a complaint on Dec. 28 in the U.S. District Court for the Central District of California against Nguyen Van Nghia and Does 1-10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it is the owner of fashiongo.net and suffered damages to its business and reputation. The plaintiff holds Nghia and Does 1-10 responsible because the defendants allegedly developed domain name fashiongo.vn that features plaintiff's trademark in order to capitalize on the plaintiff's success.

The plaintiff requests a trial by jury and seeks award profits and damages to the plaintiff, damages for cybersquatting, transfer the infringing domain name to the plaintiff, injunctive relief against the defendant, disgorgement, restitution, destruction of all infringing materials, exemplary and punitive damages, all legal fees and any other relief as this court deems just.
