Louisiana man claims Casting 360 sent him unwanted text messages

SAN FRANCISCO – A theatrical talent and booking agency is alleged to have sent unsolicited text advertisements to a Louisiana man, who has filed a class-action suit.

Scott Magee filed a complaint on behalf of himself and other persons similarly situated on Dec. 23 in the U.S. District Court for the Northern District of California against Casting Dynamics LLC, doing business as Casting 360, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that he received unsolicited text message advertisements on his cellular telephone, despite the fact that he never provided defendant with his prior express consent to receive such text messages and calls. The plaintiffs hold Casting Dynamics LLC responsible because the defendant allegedly sent unsolicited promotional text messages to plaintiff without prior express consent and invaded plaintiff's rights to privacy and seclusion.

The plaintiffs request a trial by jury and seek order certifying case as a class action;appoint class representative and counsel; damages under TCPA, including $500 per violation and up to $1,500 per violation for willful violation; declaratory judgment; costs and expenses; and further relief as the court deems just.
