Pom Wonderful claims its Super Tea mark is being used by Bai Brands

LOS ANGELES – The makers of pomegranate products allege their trademark is being used by a New Jersey company for a tea beverage.

Pom Wonderful LLC and The Wonderful Co. LLC, filed a complaint on Jan. 27 in the U.S. District Court for the Central District of California against Bai Brands LLC alleging trademark infringement.

According to the complaint, the plaintiffs allege that they suffered damages to their business and reputation from having their mark used on other competing products. The plaintiffs holds Bai Brands LLC responsible because the defendant markets its products with the SuperTea mark which infringes plaintiffs' Super Tea trademark and continued to use it despite being notified by the plaintiffs.

The plaintiffs seek enjoin the defendant from further infringing plaintiff's trademark, order the destruction of all allegedly infringing materials, all legal fees and any other relief as the court deems just. They are represented by J.P. Pecht, Michael M. Vasseghi, Christa M. Demeke and Kristina M. Diaz of Roll Law Group PC in Los Angeles.
