SAN DIEGO – Former employees of a San Diego County-based clothing retailer claims the employer violated labor codes.

Carly Heck, Sara Lund and Ally Ortanez filed a complaint on Jan. 27 in the U.S. District Court for the Southern District of California against Heavenly Couture Inc. citing the Fair Labor Standards Act and state labor codes.

According to the complaint, the plaintiffs allege that they worked without being paid proper wages or adequate meal and rest breaks. The plaintiffs hold Heavenly Couture Inc. responsible because the defendant also allegedly failed to provide accurate wage statements to their employees.

The plaintiffs request a trial by jury and seek consequential damages, statutory damages, liquidated damages, actual damages, all legal fees plus interest and any other relief as the court deems just. They are represented by Craig M. Nicholas and Alex Tomasevic of Nicholas & Tomasevic LLP in San Diego.
