LOS ANGELES – A South Korean business claims one of its textile designs was used in products without its authorization.

C&SM Int'l filed a complaint on Jan. 23 in the U.S. District Court for the Central District of California against 6two Apparel Group LTD, Burlington Coat Factory Direct Corp. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it owns exclusive rights to unique two-dimensional graphic artworks called ART-0251 for use on textiles and garments and makes sales of products bearing these designs. The plaintiff holds 6two Apparel Group LTD, Burlington Coat Factory Direct Corp. and Does 1-10 responsible because the defendants allegedly manufactured and sold products bearing plaintiff’s proprietary designs without plaintiff’s express permission.

The plaintiff requests a trial by jury and seeks an order enjoining defendants from infringing plaintiff’s copyrights in any manner, award for all profits of defendants plus all losses of plaintiff, costs of litigation and such other legal and equitable relief. It is represented by C. Yong Jeong and Amy Choe of Jeong & Likens LC in Los Angeles.
