SAN DIEGO – Two Fresno County residents allege that their former employer violated labor laws and have filed a class action.
Kelly Chang-Luna and Esteban Solis filed a complaint on March 10 in the U.S. District Court for the Eastern District of California against Ulta Salon, Cosmetics & Fragrance Inc.; Ulta Inc.; and Does 1 through 10 citing the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime compensation. The plaintiffs holds Ulta Salon, Cosmetics & Fragrance Inc.; Ulta Inc.; and Does 1 through 10 responsible because the defendants allegedly failed to pay minimum wage to the plaintiffs and did not provide meal and rest breaks.
The plaintiffs request a trial by jury and seek statutory penalties including wages, all legal fees and any other relief as this court deems just. They are represented by Matthew F. Archbold and David D. Deason of Deason & Archbold in Huntington Beach.
