SAN FRANCISCO – A Rancho Cordova licensed general contractor is accused of failing to pay contributions to labor union funds.
Board of Trustees of the Laborers Health and Welfare Trust Fund for Northern California, et al. filed a complaint on April 4 in the U.S. District Court for the Northern District of California against Timothy J. Stephan, doing business as Contract Installations, citing breach of collective bargaining agreement.
According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions from August 2016 to January. The plaintiffs hold Stephan responsible because the defendant allegedly breached his bargaining agreement with the plaintiffs by failing to remit benefit contributions on behalf of his employees.
The plaintiffs seek unpaid principal amount of $32,777.10, interest and liquidated damages in the amount of $11,610.12, interest on the unpaid fringe benefit contribution at the rate of 1.5 percent per month calculated to be $1,721.71, all legal fees and any other relief as the court deems just. They are represented by Ronald L. Richman and Susan J. Olson of Bullivant Houser Bailey PC in San Francisco.
