SAN FRANCISCO – A Santa Cruz County consumer alleges a vehicle he purchased is defective and that the defects have not been repaired.

David Cook filed a complaint on March 29 in the San Francisco County Superior Court against General Motors LLC and Does 1 through 10 citing the Magnuson-Moss Warranty Act.

According to the complaint, the plaintiff alleges that he purchased a 2013 Chevrolet Volt in March 2013 that he defects with its battery, axle and other areas. The plaintiff holds General Motors LLC and Does 1 through 10 responsible because the defendants allegedly failed to service or repair plaintiff's vehicle after several opportunities to fix the defects.

The plaintiff requests a trial by jury and seeks actual damages, restitution, actual damages, consequential and incidental damages, all legal fees, interest and any other relief as the court deems just. He is represented by Michael Devlin and Michael Resnick of Strategic Legal Practices APC in Los Angeles.
