Man alleges Swinerton Builders owes more than $68,000 for damages

SAN FRANCISCO – A former employee for a San Francisco County business alleges he was not paid for several hundred hours' worth of overtime.

James Shaver filed a complaint on April 11 in the San Francisco County Superior Court against Swinerton Builders and Does 1 to 25 citing state labor codes.

According to the complaint, the plaintiff alleges that he was employed by the defendants from April 2015 to November 2016. The plaintiff holds Swinerton Builders and Does 1 to 25 responsible because the defendants allegedly failed to pay overtime premiums to the plaintiff and provide accurate wage statements. He alleges he worked 400 hours of uncompensated overtime.

The plaintiff seeks compensatory damages no less than $68,234.80, liquidated damages, restitution, interest, all legal fees and any other relief as the court deems just. He is represented by John F. McIntyre and Kevin R. Elliott of Shea & McIntyre APC in San Jose.
