Man alleges Lyons Magnus Inc. terminated him in retaliation

FRESNO – A Fresno County man alleges that he was terminated in retaliation for filing a workers' compensation claim.

Eric Garcia filed a complaint on May 9 in the Fresno County Superior Court against Lyons Magnus Inc. and Does 1-100 alleging that they violated the Fair Employment and Housing Act.

According to the complaint, the plaintiff alleges that on Aug. 18, 2015, a supervisor and a co-worker pushed him into a food drum and injured him. He alleges he filed a workers' compensation claim and was terminated on Aug. 18, 2015, when he was released to return to work with restrictions.

The plaintiff holds Lyons Magnus Inc. and Does 1-100 responsible because the defendants allegedly intentionally harmed plaintiff and discriminated and retaliated against him by terminating his employment for filing workers' compensation claim.

The plaintiff and seeks compensatory and punitive damages, attorneys’ fees and costs of suit and such other just and proper relief. He is representing himself.
