SAN DIEGO – Three San Diego Fire-Rescue Department employees allege that they are owed unpaid wages.
Barry Links, Christopher Sovay, Steve Vandewalle filed a complaint on behalf of themselves and other employees similarly situated on May 15 in the U.S. District Court for the Southern District of California against the city of San Diego seeking declaratory judgment and other relief.
According to the complaint, the plaintiffs allege that until January of this year, they were not compensated for working more than 40 hours a week. The plaintiffs hold the city of San Diego responsible because the defendant allegedly failed to properly pay the plaintiffs overtime wages at the rate of time-and-one-half their regular rate for all hours worked over 40 hours per week.
The plaintiffs request a trial by jury and seek declaratory judgment, an order for a complete and accurate accounting of all the wages the plaintiffs are entitled to, reasonable attorney's fees and such other further relief.
