Cosmetics company accused of unlawfully using Jelly Belly mark

SAN FRANCISCO – The maker of Jelly Belly jelly beans alleges that a cosmetics company is using its mark without authorization.

Jelly Belly Candy Co. filed a complaint on May 30 in the U.S. District Court for the Northern District of California against DK Cosmetics, Jong Kyun Lee and Does 1 through 100 alleging trademark infringement and other counts.

According to the complaint, the defendants sell the Soo Ae Nature Collagen Essence Mask. The plaintiff alleges that the defendants' packaging for the product bears marks that are similar to one of the Jelly Belly marks.

The plaintiff requests a trial by jury and seeks enjoin the defendants, award damages, enhanced damages, disgorgement, destruction of all infringing products, all legal fees, and any other relief as this court deems just.
