LOS ANGELES – Kohls Department Stores and others are accused of using a textile design in a garment without authorization from a Los Angeles County corporation.
Unicolors Inc. filed a complaint on May 31 in the U.S. District Court for the Central District of California against Kohl's Department Stores Inc.; Iconix Brand Group Inc., individually and doing business as Candie's, and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its MG1175 design used without its authority. The plaintiff holds Kohl's Department Stores Inc.; Iconix Brand Group Inc., individually and doing business as Candie's, and Does 1 through 10 responsible because the defendants allegedly sold garments made out of fabrics that bear plaintiff's two dimensional design.
The plaintiff seeks to enjoin the defendants, all profits and monetary advantages, statutory damages, all legal fees, interest, and any other relief as the court deems just.
