HP Inc. accuses Alabama man contracted as service provider of fraud

SAN DIEGO – An Alabama man is alleged to have obtained hundreds of HP computer parts and claims for labor in a fraudulent scheme against the technology company.

HP Inc. filed a complaint on June 8 in the U.S. District Court for the Northern District of California against Robert H. Powell Jr., doing business as RK Powell Industries, alleging breach of contract, fraud and other counts.

According to the complaint, the plaintiff contracted with the defendant to be a third-party service provider for repair, service and customer support in 2006. The plaintiff holds Powell Jr. responsible because the defendant allegedly submitted 4,000 claims to the plaintiff in a two-year period and half of those claims were deemed as fraudulent.

The plaintiff seeks compensatory damages, restitution and disgorgement, interest, punitive and exemplary damages all legal fees and any other relief as the court deems just. It is represented by Michael J. Stortz and Matthew J. Adler of Drinker Biddle & Reath LLP in San Francisco.
