Owners claim Next Generation Realty, others failed to disclose material facts about the house

FRESNO – The owners of a Fresno property allege that they were incorrectly told the property was connected to a public sewer before they purchased it.

Kyle Crouch and Jacqueline Crouch filed a complaint on May 12 in the Fresno County Superior Court against Federal National Mortgage Association, Next Generation Realty, Mark Michno, et al. alleging intentional misrepresentation, fraud and other counts.

According to the complaint, the plaintiffs allege that on May 8, 2014, plaintiffs learned for the first time that their recently purchased property was not connected to the public sewer as advertised when they received a letter from the city of Fresno. The plaintiffs claim that they specifically asked the defendants about the property's sewer system before acquiring the place and relied on the defendants' information that the property had been inspected with a competent home inspector. 

The plaintiffs holds the defendants responsible because they allegedly failed to properly investigate and disclose facts materially affecting the desirability of the subject property and referred plaintiffs to a home inspector that was not reliable and not a licensed contractor.

The plaintiffs request a trial by jury and seek compensation for any damage to the property, reimbursement for all costs associated with connecting it to the Fresno Public Sewer System, attorney's fees incurred, disgorgement of the profits made, and any other further relief to which the court deems just and proper. They are represented by Brian K. Cuttone and Craig C.O. Waters of Cuttone and Associates in Fresno.
