FRESNO – A limited liability company alleges it was not paid for materials it provided to a construction project.

Consolidated Electrical Distributors Inc., doing business as California Electric Supply, filed a complaint on May 22 in the Fresno County Superior Court against Clark Bros. Inc., Travelers Casualty and Surety Co. of America and Does 1 through 20 citing public works payment bond.

According to the complaint, the plaintiff supplied materials to Prousys, a subcontractor of the defendants, for work on the Fresno-Clovis Regional Wastewater Reclamation Facility. The plaintiff alleges Prousys failed to pay for the materials and that it submitted a bond claim notice to the defendants and received a partial payment.

The plaintiff holds the defendants responsible because they allegedly failed to make full payment to plaintiff for the materials furnished in the construction of the project.

The plaintiff seeks payment for the sum of $121,550.56 with interest, reasonable attorney's fees, costs of suit and for such other and further relief as the court deems just and proper. It is represented by Michael I. Wayne of Law Offices of Michael I. Wayne, APC in Los Angeles.
