Laborer alleges Republic Services receptacle lid cover fell on him, caused injury

FRESNO – A Fresno County man claims that he was injured by a trash receptacle while working on a job site.

Marc Gibson filed a complaint on June 9 in the Fresno County Superior Court against Republic Services Inc. and Does 1-20 alleging negligence.

According to the complaint, the plaintiff alleges that he was working on a solar panel job site as part of his employment with Cupertino Electric. The suit states the defendants provided large metal trash receptacles for the site. On Nov. 28, 2016, while opening a large metal trash receptacle owned and provided by the defendants on the job site he was working on, plaintiff alleges was severely injured when the cover of the receptacle became unsteady, dislodged and fell on of him.

The plaintiff holds the defendants responsible because they allegedly failed to properly maintain, service, repair, operate, manage and own the subject receptacle.

The plaintiff requests a trial by jury and seeks judgment for general, special and compensatory damages; award of costs of suit incurred; expert fees; pre- and post-judgment interest; for such other and further relief as the court deems just and proper. He is represented by Jacob J. Rivas of Law Office of Jacob J. Rivas in Fresno.
