SACRAMENTO – A Dallas, Texas man alleges that a Folsom debt collector used unlawful methods to collect a debt.
Reginald Watkins filed a complaint on June 30 in the U.S. District Court for the Eastern District of California against Investment Retrievers Inc. alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff received a collection letter from the defendant in September 2016 that stated "IRI now holds title to your vehicle. We understand that you are still in possession of your vehicle." He alleges that this statement is false and that he no longer has the vehicle. He claims he has been damaged by the defendant's deceptive and misleading collection practices.
The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. He is represented by Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
