Forever 21 alleges use of stripe design does not infringe Gucci trademarks

LOS ANGELES – A Los Angeles company alleges it is not infringing a New York corporations trademarks with the use of a parallel stripe design on clothing and accessories.

Forever 21 Inc. filed a complaint on June 26 in the U.S. District Court for the Central District of California, Western Division against Gucci America Inc. and Guccio Gucci S.P.A. seeking declaratory judgment.

According to the complaint, the plaintiff alleges that the defendants sent it cease-and-desist letters regarding its use of blue-red-blue stripes in December 2016 and again in February for the use of green-red-green stripes.

The plaintiff alleges that it is not infringing the defendants' trademarks with the striped patterns on it products.

The plaintiff seeks declare that the plaintiff does not infringe any of the defendants' patents, permanently enjoin the defendants, all legal fees and any other relief as the court deems just. It is represented by Seong Kim of Sheppard, Mullin, Richter & Hampton LLP in Los Angeles.
