LOS ANGELES – A fashion, shoes and home decor retailer is accused of selling counterfeit Coach handbags and wallets.
Coach Inc. and Coach Services Inc. filed a complaint on June 28, in the U.S. District Court for the Central District of California against Citi Trends Inc. and Kelly Martin alleging trademark infringement.
According to the complaint, the plaintiff alleges that two of the defendants' shipments were seized by the U.S. Bureau of Customs & Border Protection in Long Beach and contained counterfeit goods. The plaintiff holds Citi Trends Inc. and Martin responsible because the defendants' alleged use of the infringing marks was willful, intentional and done with the knowledge that the marks were counterfeit.
The plaintiff requests a trial by jury and seeks enjoin the defendants, order the defendants to recall all goods sold, order the defendant to deliver up all infringing products, treble damages, profits, statutory damages, general, special, and exemplary damages, all legal fees and any other relief as the court deems just.
