FRESNO – A Sanger couple alleges that false representations were made to them regarding the purchase and sale of two vehicles.
Dorothy Adrian and Merle Adrian filed a complaint on June 21 in the Fresno County Superior Court against Scott Radtke, California Motoring Co. Inc., Keyes Motors Inc. and Does 1-20 alleging fraud, conversion, financial elder abuse and breach of contract.
According to the complaint, the plaintiffs purchased a 2014 Lexus from California Motoring in 2014 and contacted Radtke around January about selling that vehicle and purchasing another. The suit states the plaintiffs purchased a 2017 Lexus in March and left the 2014 vehicle with Radtke to sell through California Motoring. They allege the vehicle has been sold and that Radtke refuses to remit the sales proceeds to the plaintiffs.
The plaintiffs also allege that Radtke did not apply the $48,896.37 they paid for the 2017 Lexus and misappropriated the funds, instead directing Keyes Motors to put the plaintiffs on a payment plan through Lexus Financial.
The plaintiffs request a trial by jury and seek direct and consequential damages, disgorgement of any commissions and service fees, attorney's fees, plus interest, punitive damages and such other just and proper relief.
