LOS ANGELES — A California man has filed a class action lawsuit against a software app business, alleging violation of telephone harassment statutes.
John Simonich of Covina filed a complaint, individually and on behalf of all others similarly situated, July 19 in U.S. District Court for the Central District of California against Onshift Inc. alleging the defendant illegally contacted the plaintiff in order to offer its services.
According to the complaint, Simonich suffered damages from receiving unwanted text messages frm Onshift. The plaintiff alleges Onshift illegally sent unsolicited text messages to Simonich without his consent.
Simonich seeks trial by jury, actual and statutory damages, order the defendant to cease all unsolicited text messages, legal fees and all other relief the court deems just. He is represented by attorney Blake J. Dugger of Law Offices of Stefan Coleman PA in Phoenix.
