SAN FRANCISCO — A San Francisco couple is suing a New York real estate developer, alleging fraud and negligent misrepresentation.

Bruce W. Bell and Nancy D. Bell filed a complaint April 21 in San Francisco County Superior Court against Millennium Partners I Inc., Millennium Partners Management LLC, Mission Street Development LLC, Mission Street Holdings LLC, Transbay Joint Powers Authority and Does 1 through 100, alleging they misled the plaintiffs into purchasing a condominium property at a higher price.

According to the complaint, the Bells suffered monetary damages from purchasing a Millennium Towers condominium property at 301 Mission St., San Francisco, that was negligently misrepresented. The plaintiffs allege the defendants did not inform the Bells that the property they were purchasing had sunk more than 8 inches into the soil.

The Bells seek trial by jury, compensatory, economic, and general damages, legal fees, punitive damages, interest and all other relief the court deems just. They are represented by attorney Niall P. McCarthy of Cotchett, Pitre & McCarthy LLP in Burlingame.
