SAN FRANCISCO — A Texas woman has filed a class action lawsuit against California businesses, alleging violation of telephone harassment statutes.
Sylvia Morris filed a complaint, individually and on behalf of all others similarly situated Aug. 4 in U.S. District Court for the Northern District of California against Sunpower Corp., Modernize Inc. and Sunrona Solara LLC, alleging that they illegally called the plaintiff several times in violation of the Telephone Consumer Protection Act.
According to the complaint, in 2015 Morris suffered damages from receiving several unwanted calls from the defendants. The plaintiff alleges the defendants kept on calling her despite having been registered on the National Do Not Call Registry.
Morris seeks trial by jury, injunctive relief, treble damages of $1,500, $500 in statutory damages, all legal fees, and all other relief the court deems just. She is represented by attorneys L. Timothy Fisher and Joel D. Smith of Bursor & Fisher PA in Walnut Creek, California, and by Scott A. Bursor of Bursor & Fisher in New York.
