Virginia consumer alleges PayPal violated telephone privacy law

SAN FRANCISCO — A Virginia man has filed a class action lawsuit against PayPal, alleging violation of telephone harassment statutes.

Ramon Tovar of Richmond, Virginia, filed a complaint individually and on behalf of others similarly situated, Aug. 4 in U.S. District Court for the Northern District of California against PayPal Inc. and Bill Me Later Inc., alleging they illegally placed several calls to the plaintiff's cellular telephone, violating the Telephone Consumer Protection Act.

According to the complaint, in 2017 Tovar suffered damages from receiving several unwanted calls on his cellular telephone. The plaintiff alleges the defendants kept calling Tovar using an automatic telephone dialing system despite his requests to stop calling.

Tovar seeks trial by jury, enjoin the defendants, damages, treble damages, all legal fees, interest and all other relief the court deems just. He is represented by attorney Michael Morrison of Alexander Krakow & Glick LLP in Santa Monica.
