SACRAMENTO — A Stockton man is suing debt collectors, alleging misrepresentation in debt collection.
Roger Lo filed a complaint Aug. 3 in U.S. District Court for the Eastern District of California against Cavaalry SPV I LLC of New York and Monarch Recovery Management Inc. of Pennsylvania, alleging they wrongfully sent a collection letter to the plaintiff regarding his alleged debt, violating the Fair Debt Collection Practices Act.
According to the complaint, on Jan. 19, 2016, Lo suffered damages as the result of misrepresentations made regarding his debt. The plaintiff alleges the defendants sent a collection letter to the plaintiff, which included a settlement offer regarding a debt that he already had settled.
Lo seeks trial by jury, statutory damages up to $1,000, legal fees, actual damages and all other relief the court deems just. He is represented by attorney Crosby S. Connolly of Hyde & Swigart in San Diego.
