SAN DIEGO — A San Diego County property owner is suing a tenant and guarantor, alleging they owe nearly $86,000 for breach of a lease agreement and breach of guaranty.
Property Reserve Inc. filed a complaint Oct. 24 in U.S. District Court for the Southern District of California against Integrated Manufacturing Solutions LLC and Baophuong Nguyen, alleging they breached their duty of good faith and fair dealing.
According to the complaint, Property Reserve has suffered substantial monetary loss from the defendants' abandonment of the property at 2590 Pioneer Ave, Vista, and failure to pay all past-due rent and fees amounting to $85,912.84.
The plaintiff alleges the defendants breached the lease agreement by failing to pay rent as it came due, while the guarantor breached the guaranty by failing to pay amounts due under the lease, and forced Property Reserve to retain and pay for counsel.
Property Reserve seeks trial by jury, past-due rent of at least $85,912.84, additional amounts due and payable under the lease, attorney fees, court costs, and other relief the court deems equitable and just. It is represented by attorney Christopher S. Hill of Kirton McConkie in Salt Lake City.
