Insurance firm alleges painter/decorator owes more than $26,000

FRESNO — An insurance company is suing a Clovis painting service company, alleging it owes more than $26,000 for breach of contract.

Lexington Insurance Company filed a complaint Oct. 17 in Fresno County Superior Court against Ramon Barreto, doing business as Barreto's Painting & Decorating, alleging the defendant failed to comply with the express terms of its commercial insurance coverage.

According to the complaint, Lexington provided several commercial general liability policies to Barreto's and provided a deductible amount to effect settlement of any claim or suit. The suit says upon notification of the action taken, the insured was required to promptly reimburse Lexington for that part of the deductible amount that had been paid by Lexington. 

The plaintiff alleges Barreto's Painting & Decorating has failed and refuses to reimburse Lexington for the $26,607.66 amount demanded.

Lexington Insurance seeks trial by jury, compensatory damages in the principal amount of $26,607.66, plus prejudgment interest, costs of suit and all other relief the court deems just and proper. It is represented by attorney Adam Van Susteren of Van Susteren Law Group in San Diego.
